Acceptance of conditions
The present general conditions of sale are displayed on our site before each order taking.
The customer recognizes having read the terms and accepts them without reservation.

Copyright
Buying a photograph does not imply buying its reproduction rights in any way. The use of the pictures we supply is limited to the only family circle, according to the 1st article of the photography code.
Please contact "le t'chat et la souris" to purchase possible reproduction rights.

Orders and rates
The automatic logging method is regarded as a proof of order. The sale will only be confirmed on receiving full settlement.
Our site rates are given in €uros and are the same as our Cyber Espace Photo's.
The price of the order is the "total" price, tax and postage included.
"Le T'chat et la souris" reserves the right to cancel any litigious order.
In the event of a wrong address capture by the buyer, "Le T'chat et la souris" should not be held responsible for the non-delivery of the order.

Delivery
After the order automatic logging, "Le T'chat et la souris" commits itself to deliver to its client by post. The delivery times are the Post Office's to which 48 hours must be added for order processing.
Possible delivery time overruns can neither lead to compensation, nor deduction, nor cancellation of the pending orders.
There can be circumstances beyond the vendor's control that will discharge him from his obligation of delivery.
These are: war, riots, fire, strikes, accidents and non-delivery of raw material.
The goods are always forwarded at the addressee's risk.
For processing reasons, an order can be delivered by means of several parcels without extra charge.
If the buyer wishes to have two different delivery addresses, he must put in two different orders with a delivery fee for each.

Withdrawal
Processing and sending the pictures are only carried out on the customer's order. Therefore, no right of return other than replacement for apparent damage can be considered.
In the event of goods damaged in transit, "Le T'chat et la souris" commits itself to replace, free of charge, the damaged pictures on receiving them at the Cyber Espace Photo's address:

That procedure will not prompt any refund.

Payment
The invoiced price is the price shown in "Total orders".
The ordered pictures are payable cash on the actual day of ordering.
-By credit card: the payment can be carried out through our secure electronic transaction system.
Once authenticated, the order will only be carried out after acceptance of the payment centre.
- By cheque: the payment can be made by cheque sent by post.
Caution: a cheque should never be sent without a printed or handwritten copy of the order form. The name and address of the buyer must clearly appear on that copy for the good forwarding of the order.
The pictures will be sent when receiving the cheque and the copy of the order form.
An itemized invoice can be made on special request.

Dispute
"Le T'chat et la souris" cannot be held responsible for any damages that could result from a later misappropriation of the processed pictures (that were ordered and delivered to its client).
In any case, the responsibility of "Le T'chat and souris" will be limited to the amount of the invoice, and cannot possibly be implicated for simple mistakes or omissions that might have remained despite every precaution taken in the order processing.
Complaints and disputes will always be upheld out of regard for the presumed honesty of who takes the trouble to put his or her case forward.
In the event of any dispute, the customer should first deal with "Le T'chat et la souris", so as to reach an amicable agreement or as to allocate jurisdiction to the competent courts in the legal district of Ajaccio.
On the other hand, in accordance with our photographer 's ethics as well as with the respect of all, any recognised malevolent use of the pictures produced by "Le T'chat et la souris" will be countered without appeal.

Reserved rights
The web site www.cyber-espace-photo.com is the entire property of MABELA ltd. Any reproduction, complete or partial, is systematically submitted to the owner's authorization. However the hypertext links towards the site are welcome.
Legal information
The personal information collected for distance selling is compulsory : that information is essential to the orders' good processing and forwarding as well as to the invoicing and the drawing up of bank documents.
The want of information leads to the non-authentication of the order.
According to the law: "Informatique et libertés" ("computers and freedom"), the customer has a right of access, modification, rectification and deletion of personal data. Therefore, he can use that right with "Le T'chat et la souris". Moreover, "Le T'chat et la souris" as a "picture maker" by vocation, commits itself to keep confidential all data regarding its customer.
